These Terms of Service ("Terms") are a binding agreement between you and DolphinUp ("DolphinUp", "we", "us", or "our"), the operator of the dolphinup.com website and language-learning service (the "Service"). Please read them carefully. By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
By creating an account, signing in, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.
The Service is operated by DolphinUp. You can reach us for any question about these Terms, your account, or your content at support@dolphinup.com.
You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
You sign in using a third-party identity provider (for example, Google). You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information and to keep it up to date. Notify us promptly at support@dolphinup.com if you believe your account has been used without your authorization. You may have one account unless we agree otherwise.
The Service helps you learn languages through grammar collections, lessons, example sentences, pronunciation, video, a feedback board, and related features. We are continually improving the Service and may add, change, suspend, or remove features, content, or functionality at any time, with or without notice. The Service is provided for personal, non-commercial learning use unless we expressly agree otherwise in writing.
The Service is community-powered. You may be able to create and submit content — including grammar collections, lessons, purpose/structure pairs, example sentences, feedback posts, and other materials (together, your "Contributions").
Many Contributions are public by design. Content you submit to shared collections or to the feedback board will be visible to, and may be used by, other users and the public, and may be incorporated into shared learning material that other learners rely on. Submitting a Contribution is voluntary, and you should not submit anything you want to keep private or confidential.
You keep ownership of the intellectual-property rights you already hold in your Contributions. DolphinUp does not claim ownership of your Contributions. However, so that we can operate, provide, and commercialize the Service and the shared content within it, you grant us the following license.
By submitting a Contribution, you grant DolphinUp a worldwide, non-exclusive, royalty-free, fully paid-up, perpetual, irrevocable, transferable, and sublicensable (through multiple tiers) license to host, store, cache, use, copy, reproduce, modify, adapt, translate, reformat, correct, merge, create derivative works from, incorporate into other works, publicly display and perform, communicate, publish, and distribute your Contribution, in whole or in part.
This license is granted for the purposes of operating, developing, improving, promoting, advertising, and marketing the Service, and for other commercial purposes — including offering your Contribution as part of free or paid features, products, collections, or services — in any form, medium, or technology now known or later developed. You acknowledge and agree that we may earn revenue in connection with the Service and the content it contains, including your Contributions.
You are not entitled to any payment, credit, attribution, royalty, or other compensation for any use of your Contributions under this license, and you waive any claim to such compensation. You understand and agree that your Contributions are provided voluntarily.
Because we may edit, translate, correct, adapt, and combine Contributions to build and maintain shared learning material, to the fullest extent permitted by applicable law you waive, and agree not to assert against DolphinUp or those acting under our license, any "moral rights" or similar rights of attribution or integrity in your Contributions.
Where you submit a Contribution to a public or shared part of the Service, you also grant every other user of the Service a non-exclusive, royalty-free license to access, view, and use that Contribution through the Service and its features, as permitted by these Terms. This lets the community learn from shared content in the ordinary operation of the Service.

The feedback board is a shared, public space. You are solely responsible for what you post there. We may set, apply, and enforce community guidelines, and we may mute, restrict, remove content from, or ban any user who violates these Terms or behaves in a way that harms the community, at our discretion.
We do not pre-screen all Contributions and are not obligated to. We may, but are not required to, review, moderate, edit, refuse, or remove any Contribution at any time, for any reason, without notice. Some Contributions require approval before they become public. If you believe content on the Service infringes your rights, contact us at support@dolphinup.com with enough detail to identify the content and your rights, and we will review your request.
The Service itself — including its software, design, user interface, text, graphics, logos, trademarks, and the collections and content we create or curate — is owned by DolphinUp or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose, subject to these Terms. You may not copy, scrape, resell, or exploit any part of the Service except as expressly permitted.
Parts of the Service are built on material published by others under open licenses — most visibly the dictionary, which is derived from Wiktionary and other open dictionaries, and the pronunciation recordings hosted by Wikimedia Commons. We claim no ownership over that material, and nothing in this section restricts any right you already have under the license that applies to it. Those licenses, the sources, and the modifications we made are set out on our Third-Party Notices page. Where a license requires it (for example Attribution-ShareAlike), the corresponding data is offered back under that same license, and the terms of that license — not this section — govern your use of it.
We respect intellectual-property rights and expect our users to do the same. Much of what appears on the Service is submitted by users, and we do not review it in advance. If you believe material available through the Service infringes a copyright you own or are authorized to act for, send a notice to support@dolphinup.com with the subject line "Copyright Notice" containing:
We review every complete notice promptly and, where the claim appears valid, remove or disable access to the material. We may also suspend or terminate accounts that repeatedly infringe. If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same address explaining why, together with your contact details and signature; we will consider it and may restore the material. Submitting a notice or counter-notice that you know to be false may make you liable for damages.
Core parts of the Service are free to use, subject to usage limits we may set and change. We also offer a paid subscription ("Premium") that removes those limits. Prices, billing periods and what each plan includes are shown in the app before you buy, and any taxes are added or included as indicated at checkout.
Payments are processed by our payment provider, which acts as the merchant of record for the sale. Your purchase is therefore also subject to that provider's terms, and your card details are handled by them — we never receive or store them. A subscription renews automatically at the end of each billing period at the then-current price until you cancel.
You can cancel a subscription at any time. Cancellation stops future renewals; your Premium access continues until the end of the period you have already paid for, after which the account returns to the free plan. Cancelling does not delete your account or your content.
If you are a consumer in the European Union or the United Kingdom, you have a statutory right to withdraw from a purchase of digital content within 14 days. By starting to use Premium immediately you ask us to begin performance during that period; where the law allows, the withdrawal right ends once the service has been fully performed, and otherwise we refund the unused part. Nothing here limits any mandatory consumer right in your country.
Beyond those statutory rights, we offer a straightforward policy: write to support@dolphinup.com within 14 days of a charge and we will refund it in full, provided the plan has not been substantially used in that period. Refunds of a renewal charge are handled the same way. We also refund in full where we are at fault — for example a duplicate charge, a charge after a valid cancellation, or a prolonged failure of the Service. Approved refunds are returned through the original payment method, normally within 14 days. We may decline refunds where there is evidence of abuse, such as repeated buy-and-refund cycles.
We may change prices or the content of plans. Changes apply to your next billing period, never retroactively, and we tell you before a change takes effect so you can cancel if you do not agree. Free-plan limits may change at any time.
If you send us suggestions, ideas, or feedback about the Service itself (as opposed to Contributions), you agree that we may use them freely, without any obligation, restriction, or compensation to you.
The Service relies on third-party services — for example, Google for sign-in, YouTube for video lessons, our payment provider for subscriptions, the speech voices built into your browser or device, and providers for hosting and network delivery. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services and do not endorse them.
The open data, media and software the Service is built on — and the licenses that apply to them — are listed on our Third-Party Notices page. Product names and logos mentioned in the Service belong to their respective owners and are used only to identify those products; we are not affiliated with, sponsored by, or endorsed by them.
The Service and all content — including Contributions from other users — are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any learning content is accurate or complete. You use the Service at your own risk.
To the fullest extent permitted by law, DolphinUp and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to defend, indemnify, and hold harmless DolphinUp and its officers, employees, and partners from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your Contributions, your use of the Service, or your breach of these Terms.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, or remove your Contributions, at any time if you violate these Terms or if we reasonably believe it is necessary to protect the Service or other users.
If your account ends, we will, on request and where reasonably practicable, remove content directly tied to your profile (such as your feedback authorship). However, Contributions that have been incorporated into shared or public collections, or that have already been copied, sublicensed, aggregated, anonymized, or turned into derivative works, may be retained and continue to be used under the license you granted in these Terms. That license, and the sections of these Terms that by their nature should survive (including the license grant, your promises, disclaimers, limitation of liability, and indemnification), survive termination.
These Terms are governed by the laws of Vietnam, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the competent courts of Vietnam for any dispute arising out of or relating to these Terms or the Service. Nothing in these Terms deprives you of the protection of any mandatory consumer-protection laws of the country where you live.
These Terms are written in English, which is the authoritative and binding version. Any translation is provided for your convenience only; if there is any conflict, the English version prevails.
We may update these Terms from time to time. When we make material changes, we will update the "Effective date" above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
